Apple (AAPL) Wins Temporary Injunction Against Samsung in Australia

Apple loves the smell of victory in the morning... or any time of day, for that matter.

Reports Thursday suggest Apple (Nasdaq: AAPL) has won a motion to block Samsung from selling the Galaxy Tab 10.1 in Australia. The decision is to uphold a temporary injunction blocking the sale of the Galaxy Tab 10.1 in Australia if it is sold using features that Apple claims infringes on its patents, such as touch-screen technology.

Apple has been seeking to block Samsung from selling the Galaxy Tab 10.1 since last April, when it began saying Samsung infringed on several patents held by Apple. Apple's iPad remains the de facto standard for tablets worldwide.

One bear on Apple says the competition is really between Apple and Google (Nasdaq: GOOG). Samsung's Galaxy Tab 10.1 runs a version of Google's Android OS, which has become one of the leading mobile OS's globally next to Apple's iOS. The analyst commented "Apple has a case that it has created some innovative new technology, but on the other hand the reality is we live in an open world and you cannot because of one innovation stop the rest of the world going in similar directions," according to a quote from the WSJ.

Samsung's Galaxy Tab has already been banned in Germany, and Apple is looking for more injunction throughout Europe. The two are also tied up in litigation in the U.S., Japan, and South Korea.

Samsung, for its part, said it might appeal the ruling. The Korean company is also looking to block the sale of Apple's iPhone 4S in France and Italy on claims in infringes Samsung's wireless patents.

Apple shares are very modestly lower Thursday morning.
