Artifex Files Suit Against Palm (PALM) Over MuPDF License in Pre Smartphones

December 4, 2009 7:35 AM EST

Artifex Software claims that Palm (NASDAQ: PALM) swiped pdf software to use in its Pre Smartphone. The company has filed a lawsuit against Palm in the U.S. District Court for the Northern District of California.

The small California company claims that it is "a victim of Palm's policy to cut corners and misappropriate that which others worked long and hard to build."

Artifex says that it approached Palm to see if the company would be interested in using its MuPDF software to open pdf files. Artifex claims that Palm refused to license the software, though they acknowledged that there was value in MuPDF. Artifex requires that an entire application must be licensed under the GNU General Public License (GPL) if muPDF is part of the application. If the software is not licensed under the GNU GPL, then Artifex requires a commercial license in order to use muPDF, according to the company's licensing terms.

Artifex is seeking an accounting, profits and damages for the infringement, and delivery or destruction of all infringing devices.
